Ecomodulation describes financial incentives for producers that reward certain packaging decisions while discouraging others. Ecomodulation will be used by Extended Producer Responsibility (EPR) states to establish a fee structure. Using an ecomodulation system, fees are determined not only based on criteria like product weight, volume, material type, and waste management costs but also criteria such as recyclability, recycling rates, hazardous substances, reusability, and recycled content. For example, using ecomodulation, producers could pay more if they use hard-to-recycle plastics for their packaging. But producers who use highly recyclable material in their packaging will pay significantly less.

How is Ecomodulation used to calculate costs?

Each EPR state will start by calculating a “base fee” for each material. This fee is based on the cost and revenue of the material type and on the system costs (i.e., collection, processing, education, outreach, administrative) to manage the material. All producers pay this base rate. Ecomodulation is applied by adjusting fees according to bonuses (incentives) and penalties (disincentives). These producer-specific adjustments will either increase or decrease their individual costs, encouraging them to reduce the environmental impact of their packaging continuously.

Although the basic idea is the same, each state will handle ecomodulation a bit differently. Some states will use bonuses for products with lower environmental impacts and penalties for products with higher impacts. While other states will have an ecomodulation model that only uses penalties, like Maine. In addition, each state will have different minimum recyclables lists and requirements/categories for bonuses and penalties.

Bonuses and Penalties

While the bonuses and penalties will vary from state to state or region to region, here are some examples from already established EPR programs.

Bonuses:

  • Use materials with the most developed recycling channel
  • Improve recyclability potential
  • Reduce the weight of packaging or the number of units at the source
  • Incorporate recyclable materials into your packaging
  • Elimination or substitution of a problematic material
  • Promotion of consumer sorting in media campaigns
  • Use of reusable and standard packaging

Penalties:

  • Designs and practices that increase the costs of recycling
  • Designs and practices that disrupt the recycling of other materials
  • Using covered materials that are not on the minimum recyclables list


Effects of Ecomodulation System

An effective ecomodulation system will standardize and create a strong end market for recyclables and drive demand for recycled feedstock. To keep up with this demand, investments have to be made in collection, sorting, and processing capacity. This can be achieved by using funds from EPR fees to develop and enhance recycling streams for various materials.  Investing in technology like AI and robotics, in recycling facilities is critical to ensure higher volume and quality of recycled content.
